Damien McDaniel was in court on Thursday as a suspect in the Five Points South mass shooting, but it wasn't his first time in a courtroom.McDaniel's criminal history started in 2019 when he was just 17 years old. He was arrested on two counts of attempted murder. He would later plead guilty to both counts in 2023 and be sentenced to 15 years in jail.According to court records, McDaniel received a split sentence. That means he was sentenced to 2 years jail time, and the other 13 years were suspended. He was also given credit for time served, meaning McDaniel was released on a three-year probation.A motion to revoke that probation was filed last week, according to Jefferson County Bessemer cutoff District Attorney Lynniece Washington."A part of the conditions of probation is you're not supposed to be around injurious and vicious people, not be in disreputable places or around people with bad character," Washington said. "He was in violation of at least two of those conditions."In 2021, McDaniel was arrested again after picking up another intentional murder charge. That case was sent to a grand jury, and it was not billed and dropped. Charges were never refiled.Just last month, McDaniel allegedly killed six people over a 72-hour period.The first shooting happened just after 8 p.m. on Thursday, Sept. 19, at the 604 Bar & Lounge on 9th Street North, according to the Birmingham Police Department.Upon arrival, officers entered the bar, where they found 35-year-old Diontranet Tinae Brown suffering from a gunshot wound. Brown was taken from the scene with life-threatening injuries and later died at UAB Hospital. McDaniel is charged with her murder.Just a few nights later, on Sept. 21, gunfire erupted outside Hush, a hookah and cigar lounge, killing four people and leaving 17 others injured. McDaniel has been charged with capital murder and 17 counts of attempted murder.The following night, officers responded to the South Eastlake area in response to a Shot Spotter alert.Officers arriving at the scene found 32-year-old Jamarcus McIntyre lying on the sidewalk, suffering from a gunshot wound. He was pronounced dead at the scene.Officers also located a woman suffering from a gunshot wound in a nearby front yard. She was taken to UAB and treated for non-life-threatening injuries. An injured adult male also arrived at St. Vincent’s East by private vehicle.McDaniel is charged with capital murder and three counts of attempted murder in that case. He also faces charges of unlawful possession of a firearm and unlawful possession of marijuana, both of which were found in McDaniel's possession when he was arrested.
